User Generated Content T&Cs
We love seeing our products on your social media and sometimes we may request to share these pictures/videos (Content) on our channels.
1. Grant of licence
By replying #mywaxmanhome (or otherwise confirming in writing), you grant Waxman Ceramics a non‑exclusive, royalty‑free, worldwide, perpetual and irrevocable licence to:
- Use, reproduce, publish, display and communicate your photos and/or videos (“Content”);
- Edit, crop, resize, adapt and otherwise modify the Content, including adding graphics or text;
- Combine the Content with other materials;
- Use the Content in any media or format now known or developed in future; and
- Sub‑licence these rights to group companies, advertising agencies, printers and other partners
For commercial, advertising and promotional purposes, including on our websites (including product pages), social media, email marketing, digital advertising and printed materials.
2. Ownership, permissions and warranties
You warrant and represent that:
- You are the creator and copyright owner of the Content and have authority to grant this licence without infringing anyone else’s intellectual property rights;
- You are over 18 and legally able to agree to these T&Cs.
- The Content does not infringe any copyright, trade‑mark, privacy, publicity or other third‑party rights;
- You have obtained permission from all people shown in the Content; and
- The Content is not AI generated, unlawful, defamatory or misleading.
By giving Waxman Ceramics permission to use your content, you agree not to make any claims against Hug Rug or associated companies for how it uses that content, now or in the future. This includes claims related to privacy, copyright, publicity, or confidentiality. You understand that Waxman Ceramics may adapt or edit your content for use on social media.
While Waxman Ceramics will aim to use your content respectfully, you acknowledge that it may be presented in ways you might not personally endorse.
3. Indemnity
You agree to indemnify and hold Waxman Ceramics harmless from any claims, damages, losses, liabilities and costs (including reasonable legal fees) arising from your breach of the warranties above or any third‑party claim relating to the Content.
4. Editing and moral rights
You consent to Waxman Ceramics editing, adapting and modifying the Content for formatting and promotional purposes.
To the extent permitted by law, you waive any moral rights you may have in the Content, including the right to be identified as author and the right to object to derogatory treatment.
5. No compensation clause
You acknowledge that you will receive no payment, royalties, credit or other compensation for the use of the Content now or in the future unless specified otherwise by Waxman Ceramics
6. Removal requests
You may request that we cease future use of your Content by emailing website@waxmanceramics.co.uk We will stop using it within a reasonable time, but this will not apply to materials already printed, distributed, published or included in live campaigns.
7. Data protection
If the Content identifies an individual, it may constitute personal data. We will process such data for marketing purposes in accordance with our Website Privacy Policy. Your affirmative response of #ymywaxmanhome constitutes consent to such processing. You may withdraw consent at any time, but prior use remains lawful.
8. Governing law and jurisdiction
These terms and any dispute or claim (including non‑contractual disputes or claims) arising out of or in connection with them are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
